ACKNOWLEDGEMENT

I hereby acknowledge that there are certain dangers, and potential injuries, which may result from unavoidable accidents or injuries, or from any activities or from my physical condition occasioned by my usage of Copenhaver Park. I expressly acknowledge, on behalf of myself and my heirs, and executors, and all my guests and invitees, that I assume the risk for any and all dangers, illnesses injuries and damage that may result, directly or indirectly, from my usage of Copenhaver park or that of my invitees or guests.

CONSIDERATION

In consideration of Copenhaver Homes Corporation allowing me to use Copenhaver Park for the express purpose of ___________________, on __________, and for other good and valuable promises made herein, I expressly agree to terms and conditions contained within this Copenhaver Field Permit / Park Waiver Form.

RELEASE

I forever discharge Copenhaver Homes Corporation and their directors, representatives, employees, successors and assigns (the "Releasees"), from and against any and all rights and claims for any claim, loss, costs (including attorneys' fees), damage or injuries to person or property sustained as a result of the usage of Copenhaver Park by myself or that of my guests, or invitees, whether or not such loss, damage or injury results from the negligence of the Releasees or from some other cause.

INDEMNIFICATION

I hereby agree to indemnify and save and hold harmless the Releasees, each of them, from any claims, loss, costs (including attorneys' fees), liability, damage or cost that they may incur due to my use and the use of my guests and invitees in, upon or about Copenhaver Park.

ACCEPTANCE

I agree to the terms and conditions set forth on this Copenhaver Field Permit / Park Waiver Form.
